The Department of Lands and Survey has not issued any decision regarding an increase in real estate assignment fees for 2026, whether for Jordanians or foreigners. The real estate assignment fee remains 6%, applied to all types of properties including villas, land, farms, etc.
The assignment fee rate for all property types is unified for Jordanians and non-Jordanian foreigners at 6%, except for apartments, where the assignment fee varies according to specific criteria.
6% is the fixed real estate assignment fee for Jordanians and non-Jordanian foreigners for all property types such as land, villas, farms, residential complexes, and others.
Apartments are the only property type where assignment fees vary as follows:
● The first 150 square meters of the apartment area are completely exempt from fees (0% assignment fee).
● A 3% assignment fee applies to the area exceeding 150 square meters, calculated based on the administrative value of the apartment.
● 1.5% assignment fee if the buyer is purchasing an apartment for the first time.
● 3% assignment fee for the first 150 square meters of the apartment area.
● 6% assignment fee for the area exceeding 150 square meters.
● 4.5% assignment fee if the apartment is being purchased for the first time.
Real estate assignment fees are calculated based on the registered area stated in the title deed and each partner’s share of the property, using the administrative value approved by the Department of Lands and Survey.
Area in square meters = (Total area × Partner’s share) ÷ Total shares
Example:
If an apartment area is 200 m² and the owner’s share is 50%, fees are calculated on 100 m² only.
Note that the total area refers to the area registered in the title deed.
Since this article focuses on real estate assignment fees for Jordanians and other nationalities, it is important to highlight the conditions for non-Jordanian foreigners to own property in Jordan. These conditions must be fulfilled in two stages:
● Attendance of the concerned person, an authorized agent, or a licensed and officially authorized real estate office at the Legal Affairs Directorate – Investment Facilitation Department.
● Obtaining approvals from the Ministry of Interior, the Council of Ministers, and the Ministry of Finance.
● 1 working day if approval is issued by the Director General.
● 4 days if approval is issued by the Minister of Finance.
● 15–20 days if approval is issued by the Council of Ministers.
● Visit the Investment Facilitation Department to fill out the ownership application.
● Review / transfer the application to the Investment Facilitation Department to audit the application, attachments, and purpose of ownership.
● Visit the Registry Department to submit the application.
● Send the application electronically with attachments to the Ministry of Interior or issue an official letter requesting the Ministry’s opinion, signed by the Director General.
● Once approval from the Ministry of Interior is received, a recommendation letter is prepared for the relevant authorities (Director General of the Lands Department – Minister of Finance – Council of Ministers).
● After approval, it is sent electronically to the relevant Registration Directorate for execution, followed by an SMS notification to the applicant.
